1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Keepsake mobile application (the "App") operated by Keepsake ("we", "our", or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Description of the Service

Keepsake is a mobile application that allows users to capture, organize, and rediscover memories connected to meaningful physical objects.

Users can create "keepsakes" containing media and descriptions associated with items they have chosen to preserve.

Keepsake is designed as a local-first application, meaning user data is stored primarily on the user's device.

Optional cloud synchronization may store data within the user's personal cloud account.

Keepsake does not host user memory data on company servers.

3. User Content

Users may create and store content within the App, including:

Keepsake does not claim ownership of user-generated content.

You are solely responsible for the content you create, store, or share through the App.

4. Data Ownership and Storage

Keepsake is designed to ensure that users maintain control over their data.

Users may export their data at any time.

5. Cloud Sync and Sharing

Some features of the App may allow users to synchronize content across devices or share memory collections.

Use of these services is subject to the terms and privacy policies of the respective providers.

6. Subscriptions and Purchases

Keepsake may offer paid features through monthly subscriptions, yearly subscriptions, and a one-time Lifetime purchase.

Monthly and Yearly Subscriptions

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. Payment will be charged to your Apple ID account at confirmation of purchase. You can manage or cancel your subscription at any time through your Apple ID account settings.

Lifetime Purchase

A Lifetime purchase grants access to the purchased features of the Keepsake app for the lifetime of the product, subject to platform availability.

The lifetime of the product refers to the period during which the Keepsake application remains available and supported on applicable app distribution platforms, such as the Apple App Store.

If the Keepsake application is discontinued, removed from distribution platforms, or no longer supported, access to the app and its features may end.

Users maintain access to their stored Keepsakes and may export their data from within the app at any time using the export features provided by the application while the service remains available.

Billing and Refunds

All purchases and subscriptions made through the App Store are processed by Apple. Refund requests and billing disputes must be handled through Apple in accordance with Apple's policies.

Subscription Pricing Changes

We may change subscription pricing from time to time. If a subscription price changes, the updated price will be communicated to you in advance in accordance with App Store policies.

For existing subscribers, any price changes will only take effect after the current billing period and may require your consent as required by Apple. If you do not agree to the updated pricing, you may cancel your subscription before the next billing cycle.

All subscription billing, renewals, and pricing changes are managed through Apple's App Store and are subject to Apple's terms and policies.

7. Acceptable Use

You agree not to use the App to:

Keepsake reserves the right to restrict access to the App if misuse is detected.

8. Service Availability and Discontinuation

We strive to maintain and support the Keepsake application; however, we do not guarantee that the service will be available indefinitely.

We reserve the right to modify, suspend, or discontinue the Keepsake application or any of its features at any time.

If the Keepsake application is discontinued, we will make reasonable efforts to provide notice where possible. Users will continue to have the ability to export their stored Keepsakes using the export functionality available within the app while the service remains accessible.

9. Third-Party Services

Keepsake may interact with third-party services including cloud storage providers and the Apple App Store.

Keepsake is not responsible for the availability, functionality, or policies of third-party services.

10. Limitation of Liability

Keepsake is provided "as is" without warranties of any kind.

To the fullest extent permitted by law, Keepsake shall not be liable for any indirect, incidental, or consequential damages resulting from:

11. Termination

You may stop using the App at any time.

You may delete your data directly from the App or by removing the App from your device.

Because Keepsake does not maintain user accounts or store user data on company servers, deletion of the App removes access to locally stored data.

12. Changes to These Terms

We may update these Terms from time to time.

If significant changes are made, the updated Terms will be made available within the App or through our website.

Continued use of the App after updates constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and interpreted under the laws of the jurisdiction in which the operator of Keepsake resides, without regard to conflict of law principles.
